Mark J. Cipolla Esq.
Mark J. Cipolla joined Aidala Bertuna and Kamins to lead our civil trial practice. With a dynamic and diversified body of trial experience built over his more than 20 years as an attorney, Mark brings a depth of knowledge and experience that adds value to the firm’s existing clients while nurturing the firm’s expanding vision. Mark’s experience includes partnership at two of the nation’s largest and most well respected law firms where he handled thousands of claims valued into the multi-millions. Whether by jury verdict, binding arbitration, motion or appellate practice, or negotiated settlement, Mark’s efforts have resulted in both the recovery and savings of multiple millions of dollars for his clients.
Following law school and a successful tenure as a Kings County Assistant District Attorney, Mark joined Wilson Elser Moskowitz Edelman and Dicker in 1998. In 2001 Mark was elevated to partner and remained at the firm until 2007. Over his years at Wilson Elser, Mark handled personal injury cases, supervised numerous accounts, and associates. Building on his experience as a prosecutor, Mark developed an expertise in premises security litigation, handling cases involving crime victims’ injuries suffered in public and private housing complexes and commercial establishments. Building on pre-lawyer construction experience, Mark also developed expertise in elevator accident cases, while simultaneously handling cases involving hospital liability, municipal liability, civil rights violations, premises liability, including accidents involving slip and trip and falls, snow and ice, lead paint exposure, medical and architect malpractice, bar and restaurant “Dram Shop” liability, automobile accidents, after-school and school bus injuries, and property damages. On the commercial side, Mark drew on his experience to expand his practice by handling claims of construction cost over runs.
In 2007, presented with an opportunity to join another prestigious firm with growth and expansion sights, Mark accepted partnership at the New York office of California based Lewis Brisbois Bisgaard and Smith. There, Mark continued to add to his impressive body of trial work, adding a significant amount of construction site accident and retail liability cases to his resume. Mark continued to handle construction cost litigation, while also handling cases involving injuries as a result of products liability, lead paint exposure, airport premises accidents, dental implant liability, food and maintenance service related accidents, civil rights violations, assaults, burns, and class action medical malpractice.
Over the years, Mark has tried cases involving claims by construction workers for job site injuries, crime victims for injuries received due to claims of inadequate premises security at apartment buildings and department stores, health care workers and visitors for claims of injuries received in elevator and trip and fall accidents, health care provider patients for negligence and medical malpractice, pedestrians due to street and sidewalk defects, and construction site materials, consumers and workers due to products liability, and automobile accidents.
In addition to his trial and litigation achievements Mark has given presentations on subjects including post traumatic stress disorder, trial practice, recovery of legal fees, use of vocational rehabilitation and medical experts, jury selection, and the inspection duties of federally funded residential landowners. Mark has also assisted clients in drafting contracts and assessing risk management strategies.
Mark received a Bachelor of Science Degree from St. John’s University in 1986. While in college and prior to attending law school Mark worked as a union construction laborer, and a New York City Public School’s substitute teacher. Mark received his Juris Doctorate from St. John’s University, School of Law, graduating from the night program in 1992.
Mark is admitted to practice in the Supreme Court of the State of New York and both the Eastern and Southern Districts of New York. On numerous occasions he has called upon to consult on matters in other jurisdictions, and has been admitted outside New York to serve as lead trial counsel.
Outside of the office, Mark is very actively engaged in the community. A lifelong New York City resident, Mark is an active member of numerous charitable, civic, faith based, and fraternal not for profit organizations, and professional associations, and throughout the years he has coached various youth sports teams.
