An overview of knife rules in New York

Non-United States citizens are not allowed to own a knife in the state of New York. Furthermore, switchblade and gravity knives may be prohibited if an individual does not have a hunting or fishing license. Owning a knife that has been adapted to be primarily a weapon is also against the law in the state.

Daggers, hunting knives and stilettos are are legal to own and carry within New York. Those who carry throwing stars, cane swords or any other prohibited knife may be guilty of fourth degree criminal possession of a weapon. If a person intends on using a knife against a person, it may also be considered fourth degree criminal possession of a weapon even if that knife is otherwise legal to possess.

Assuming that a knife is legal to carry in the state, it may be done in a concealed manner. This also assumes that the knife is not intended to be used against another person or to otherwise commit a crime. However, if someone is found in possession of a knife, he or she will be assumed to have it to commit a crime. This assumption may be rebutted in court by claiming self-defense or by claiming another justifiable reason to have a knife.

If an individual faces these types of weapons charges, it may be worthwhile to have the representation of an attorney, as the consequences of a conviction are severe. An attorney may argue that a person had a knife for self-defense for another lawful reason. It may also be possible to point out that a person had a license that made it legal to carry a certain knife or other weapon.
