Woman charged with DWI in New York state

New York state troopers say that a woman driving a Dodge Durango struck a bicyclist while he was riding eastbound on State Route Five. The woman did not stop after striking the 62-year-old man, but they were able to locate the vehicle on the same road and conduct a traffic stop. When police made contact with the woman, it was discovered that a 2-year-old and a 4-month-old were in the vehicle with her.

The woman was charged with two counts of endangering the welfare of a child as well as reckless endangerment in the first degree. Furthermore, she was charged with leaving the scene of an accident and two counts of aggravated DWI. Authorities say that the driver was sent to Little Falls Court and then to Herkimer County Jail. The bicyclist was treated at St. Elizabeth's Hospital for minor injuries.

If a person is found to be driving under the influence of alcohol or any other substance, he or she could face significant legal penalties. It may be possible to spend time in jail, pay a fine or lose the ability to drive a vehicle. If a person is allowed to drive after being convicted of a DWI, that person may be required to use an ignition interlock device. As a drunk or impaired driving charge is a serious one, it may be a good idea to consult with an attorney.

An attorney may review the case and create a strategy to defend against the DWI charge. Defense strategies may include asking to see calibration or police training records for the Breathalyzer machine used during a traffic stop if a breath test was conducted. An attorney may also seek to throw out police or witness testimony or cast doubt on that testimony during a trial.
