NASCAR chairman and CEO facing drunk driving charges

New York NASCAR fans may be interested to learn that the NASCAR chairman and CEO Brian France was taken into custody on Aug. 5 after police conducted a traffic stop on his vehicle. According to the Sag Harbor Village Police Department, France failed to stop at a stop sign at about 7:30 p.m.

Authorities determined that Brian France was driving while intoxicated. His blood alcohol level was reportedly .18 percent, which is well over the state's legal limit. Police say that his eyes appeared glassy, he lacked balance and his speech was slurred. During a search of his vehicle, authorities allegedly found five oxycodone pills.

He was held until the next morning and arraigned before being released. He is reportedly facing aggravated DWI charges in addition to drug charges and is scheduled to appear in court on Sept. 14. Following the news of his arrest, France stated that he was taking an indefinite leave of absence. In the meantime, his uncle Jim France was announced to be taking over as interim chairman and CEO.

The consequences for being charged with drunk driving can be severe, even if a person has not yet been convicted of those charges. Associated consequences could include heavy fines, loss of driving privileges and even a jail sentence if there were aggravating circumstances or if the person has prior drunk driving convictions. However, a criminal law attorney may fight the charges by analyzing the evidence brought against the accused person by the authorities. In some cases, the results from breathalyzers and other drunk driving tests may be challenged if the device was not properly used or if the officer was not properly trained to use it.
