New York man charged with felony DWI

On Aug. 6, a New York man was arrested on suspicion of drunk driving in East Hampton. He was also charged with driving without an ignition interlock device.

East Hampton Town Police report that an officer spotted the defendant, a 34-year-old Sag Harbor resident, driving erratically on Montauk Highway around 2:25 a.m. He allegedly failed to keep his vehicle to the right and also failed to use the designated lane. The officer pulled him over and noticed that his breath smelled like alcohol and his eyes were glassy and bloodshot. He also allegedly slurred his speech and appeared unsteady on his feet. The officer asked him to perform a series of standardized field sobriety tests, which he reportedly failed.

The defendant, who was previously convicted of DWI in 2008 and 2009, was placed under arrest. Because he is a repeat offender, he was charged with felony DWI with two previous convictions of the designated offense within two years. He was additionally charged with felony first-degree aggravated unlicensed operation of a motor vehicle because his license has been suspended 12 times in the past. He was also charged with misdemeanor driving without an ignition interlock device.

A conviction on drunk driving charges can lead to serious consequences in New York, particularly if the defendant is a repeat offender. Defendants facing such charges may be able to help their situation by contacting a criminal defense attorney for help. An attorney could review the case, challenge evidence and work to get the charges dismissed. If the charges are solid, the attorney could approach prosecutors about a plea deal to reduce the penalties.
