Proven Litigators To Assert Your Rights

New York man faces third DWI charge

A 52-year-old New York man was charged with two felonies following a traffic stop on the Taconic State Parkway on July 16. The incident occurred around 8 p.m. when New York State Police troopers observed the man in a 2017 Chevrolet Silverado committing a traffic violation.

The troopers stopped the man and discovered he was driving under the influence of alcohol. Furthermore, because of previous driving while intoxicated charges, his license had been revoked. This was the man's third charge for DWI.

The man was taken into custody. He is facing charges of driving while intoxicated with two prior convictions and aggravated unlicensed operation of a motor vehicle. He was arraigned and sent to the Westchester County Jail with a bond of $15,000 or a cash bail of $10,000. His next court appearance was scheduled for July 19.

Drunk driving charges can be serious whether they are a first-time offense or the person has multiple convictions. Charges of driving while intoxicated can affect some people's career paths or other aspects of their lives. A person facing these types of charges may want to talk to an attorney about the options. First, an attorney might consider whether the person's rights were violated during the traffic stop or while being taken into custody since this could lead to the dismissal of evidence or the case. An attorney might also look at the accuracy of the Breathalyzer test. Depending on the severity of the charges, the person could be offered an option for a plea bargain. With a plea bargain, a person does not go to trial and usually pleads guilty to reduced charges in exchange for lighter penalties.
